It is reassuring to see a constitutionally driven decision. Thank you Julie.

Given DC circuit's track record, I was not super hopeful about this. Always happy to be pleasantly surprised!

Marvin Cragin's avatar

This was significant to get right.

"Tensions between Dellinger's assertions"

A refined DC Circuit way to say, "Shoveling the BS so thick and fast they can't keep the falsehoods straight."

Julie Kelly's avatar

I would have preferred that but I'll take whatever shade we can get!

Julie, thank you for keeping us up to date, and also always informing us who is married to whom.

Julie Kelly's avatar

And Chris Cooper, Amy Jeffress husband, just ordered a rolling production of DOGE records to a leftwing activist group.

James Thomas's avatar

I wonder if Big Balls, et al are doing some sleuthing on the "leftwing activist group." I would be.

DC is a very incestuous cadre

Amy Berman Jackson got slapped upside of the head. That's a further reason why this case cannot be mooted at this point - that record needs to be made. There needs to be some form of judicial review of her continuing to serve.

You were kind to her, Julie.

The incest in the DC courts you regularly point out, as in this piece, is not to be believed.

I really was too nice. So unlike me lol. I wanted to get this up as soon as possible so I was in anti-snark mode. I promise I'll make it up to you!

A constitutionally appropriate decision from the DC Circuit yet. Wonders never cease. One by one, I guess. Patience grasshopper.

Julie Kelly's avatar

My guess is they had no choice. Given SCOTUS rulings in two other similar cases, DC circuit did not want to risk another embarrassment at the high court. And Dellinger really hurt himself by seeking to reinstate fired employees. That's what arrogance will do to you!

Great piece! Does DJT have his sc ready?

Julie Kelly's avatar

Yes. Right now it is Doug Collins but only on a temporary basis.

Walt Nelson's avatar

has it always been that every presidential action was subjected and rejected by asingle court judge?

Julie Kelly's avatar

Not until Trump!

Thanks for the update Julie. You are vindicated once again. Take another proud lap knowing that you have successfully reported the truth. If there were more honest journalists like yourself there would be less rouge judges daring to subvert the courts. Godspeed as you take the incoming. Your integrity is your armor.

Julie Kelly's avatar

Oh, Elizabeth, thank you! So grateful for those kind words...

You just provided another terrific summation of a complicated case, Julie. It is somewhat comforting to learn that there are at least two, and perhaps three, Marxists-Wearing-Black-Robes inside Moscow-on-the-Potomac who seem to have a modicum of knowledge about the U.S. Constitution as demonstrated by this decision. But to your point about the length of time it will require for this case to percolate up to the Supreme Court (SCOTUS), as well as other of the lawfare cases filed against President Trump, this stalling tactic still has the potential of scuttle the President's agenda. All we can is to be prayerful and hopeful that by some miracle one or several of these cases actually gets to SCOTUS and the resulting decision serves the purpose of eliminating the remainder of the lawfare cases. Although we know it is a fool's errand to depend upon the Chief Justice and the nominal Conservative female justice, don't we? Even so...

Julie Kelly's avatar

SCOTUS has acted shamefully but even in this case, the appellate judges understood recent case law would result in Dellinger's dismissal and a win for the president.

There are so many cases in DC right now that it's impossible to keep up. New lawsuits filed almost every day.

Rev. Karlan Fairchild, MDiv's avatar

Which is precisely the reason that one, or more, of these cases need to be adjudicated at SCOTUS and, in the process and only if this is achievable in jurisprudence, of course, SCOTUS must issue a ruling that bars lower tier District judges from interfering with the Constitutional authority given to President Trump.

It's hard to imagine a case against Trump is so bad that that the fecal sewer of the DC Appellate Court tosses it out, and unanimously to boot. Normally at the start it goes something like this: Lawyer - "Your honors-" Judge 1 - "Stop right there, ruling against Trump!" Judge 2 - "I concur, but is Trump the plaintiff or the defendant?", Judge 3 - "What difference does it make? I concur as well. Now get out of here before we hold you in contempt." Such is the state of justice in the DC fever swamp.

Thanks Julie! So appreciate it when you continue to deliver up-to-date information and the results on cases such as Dellinger's that we otherwise wouldn't hear or read about.

These embedded federal officials, like Dellinger, as well as the employees of the federal government believe they are "entitled" to continue to undermine the Administration, and feed off the taxpayers as they act to erode the fabric of our country. But, they will be sorely mistaken. When the rights of our Constitution have been twisted into a narrative that is driven by agenda, people like Dellinger and his hero Garland, made us weak, divided, and fearful. So, the time has come to untie the knots we came to live under without realizing how dangerous our government had become.

In the case of USAID, it was a mouth dropping storm of fraud and abuse to show us that not only did it give money for culturally unacceptable ideologies across the globe, but funded terrorists groups, and seriously interfered in the elections within other countries to promote regime change. Learning US Ambassador to the UN under Obama-Biden, Samantha Power, was the head of the USAID, just said it all. She illegally unmasked 260 Trump campaign advisors, and future appointees of Trump during the launch of Crossfire Hurricane, where an indictment for Power is in order. She and Dellinger (and many, many others) need to become the defendants on the other side of the Lawfare they used against us all.

Of course, standing in the limelight as Julie point out are Amy Berman Jackson and Rudy Contreras two of the stars in the crucification of the defendants of January 6. Both need to be indicted for unlawful use of their authority to abuse their powers under a cloud of lies, fabricated testimony, concealing exculpatory evidence of videos that would have resulted in no charges. Yet they used these tactics like fascists to sentence American citizens to years in jail, destroying their lives. So, the time has come for the shoe to be on the other foot of the bench. And, I hope their trials will be made public.

None of the Appellate Three might be seen sweeping the stairs at the SCOTUS building? Nah, ignore that, what was I thinking....!

The lawsuits keep coming--and wasting resources at DOJ better spent on real issues as well as exposing all the bad actors.
