The media and self-proclaimed “legal experts” have stepped up their attacks on U.S. District Court Judge Aileen Cannon after she asked for draft jury instructions in Special Counsel Jack Smith’s indictment against the former president for unlawfully keeping national defense information at Mar-a-Lago.
I’ve been in the courthouse in Fort Pierce, Florida three times in the past few months to observe the court proceedings and Judge Cannon’s no-nonsense approach. Hostility between the DOJ and the judge, as I explained in my new article for Real Clear Investigations, dates back to August 2022 and Trump’s lawsuit seeking a “special master” to handle evidence seized during the nine-hour armed raid.
In filings late last week, the bad blood spilled out in public after Smith filed a threatening response to her request for jury instructions. Smith demanded that Cannon issue an order related to the instructions (she does not have to at this stage) and warned he would take the exceedingly rare step of seeking a writ of mandamus before the 11th Circuit directing her to do so. (More on this in an upcoming column.)
As the media continues its pressure campaign to get Cannon kicked off the case, this article should be a helpful backgrounder to explain what the manufactured outrage is all about.
