Smith's losing streak before the highest court continues as both of his federal indictments against Donald Trump are in peril--as is the special counsel himself.
Maybe it was my experience as a criminal defense attorney at both the trial and appellate levels in the federal court system, but I loathed Jack Smith on sight. I have known so many federal prosecutors like Smith - smug, arrogant zealots only too happy to serve as hit men for a weaponized DOJ, convinced of their own righteousness, and able to pervert the system of justice because they were backed up by the crushing power of the federal government. If you imagine Smith 700 years ago, you just know he would have been in a state of aroused tumescence watching “witches” being burned at the stake - like Torquemada on his birthday. The defense bar used to pray for clients like Donald Trump: people with sufficient resources and moxie to fight the Jack Smiths every step of the way. For the most part, they’re not even very good trial lawyers, because they benefit from such a gross imbalance of power that they get dumb and lazy, like a ham-fisted bully who never really learned how to fight.
This, I believe, is the perfect description Smith; a smug, arrogant zealot (hit man?) who is lazy, sloppy, and dumb. I added the dumb, which he certainly seems to be.
Here is a great quote of yours in reference to Smith and federal prosecutors like him:
"convinced of their own righteousness, and able to pervert the system of justice because they were backed up by the crushing power of the federal government." People like Smith are able to be "backed up by the crushing power of the federal government" because the entire judiciary, both federal and state, operate artifices to defraud. They blind the public from knowing that federal prosecutors like state ones have to be admitted to practice law in a state which gives that state the power to regulate them by the rules of professional conduct. Both the judiciary and the state bar associations hide this reality thus enabling this "crushing power of the federal government."
The Supreme Court has done as much as it could do to protect the presidency and former presidents from political persecution. Unfortunately, it cannot substitute for integrity. Prosecutors should not bring novel cases based on phony political narratives that have both the intent and effect of interfering in an upcoming election. Judges should not allow such cases to proceed. For 248 years, the integrity of lawyers, prosecutors and judges was sufficient. Thanks to Obama, Biden and the Democrats, it’s not anymore.

on politically unpopular defendants. It's most infamously done when the prosecutors present their cases to the news media before the cases reach trial thereby producing jury nullification. With that as a background, is it any wonder that they also are free to produce "phony political narratives."

Julie Kelly, woman, I'm I glad I finally have found out about you! This is a great piece that I thoroughly enjoyed reading. Oh my, how thoroughly the Democrats and many Republicans (who don't do research) have been fooled by the media and the Democratic elite! Still, they remain fooled, and it is so sad. Haha! I am sitting back, enjoying all the chaos that they have created, and that is still to come. We have a full-on Democratic shit show that is more entertaining than all their lies put together have been. I cannot wait until they lose their power. And I'd love to know who is running this country anyway?
So Smith will continue to trample the Constitution without fear of any retribution. The deep state protects its own and this guy will also get a pass. Plus he is bleeding Trump dry with all the motions he has to file in 2 jurisdictions, plus appellate and Supreme Court filings. Smith gets unlimited funding from Uncle Sugar and will undoubtedly get another government gig after this train wreck finally unfolds.
Thomas’s concurring decision was so different from what he normally writes, but he got straight to the point: we haven’t had a President or former prosecuted since the birth of the Republic, although there were crimes committed. (My understanding of that is that Presidents have had immunity, but it was never encoded.) But then he moved immediately to make the case for the illegal appointment of Jack Smith, leaving all the citations for Cannon to make the decision.
In light of the seriousness of these charges, this article was hilarious! And it appears Jack(ass) Smith may maintain his record that is unblemished with success.
I remain shockingly astonished that the disbarment has not happened of Andrew Weismann, Jack Smith, and their gangster gov't judicial associates who continue to lie and ignore the US Constitution and twist US law. You would think after Weismann's Enron false and unprincipled prosecution and his miscreant attempts with Mueller's Russian Hoax investigation.... AND Smith's Governor McDonnell wrongful prosecution, MY GOD, why are they not disbarred?????
The Dems and MSM belittle Judge Cannon at every opportunity for her deliberate and thoughtful methodology . And they support their claim that her tenure is too brief by quoting a supposed communication by two of her senior tenure peers who attempted to muscle her out of the way so that one of them could bask in the media spotlight. Thank goodness ness she resisted and the case is being tried in her courtroom.

He is a nothing more than a political hack. It is downhill from here for Smith, thankfully. I look forward to seeing how Judge Cannon deals with these issues. I know you did not think she would grant the motion to dismiss based on the illegality of Smith's appointment before the immunity decision. This is a golden opportunity for her to do the right thing, grant the motion with a decision that will likely be affirmed by SCOTUS that ends Smith's career and reputation once and for all.
