Julie - can you report on what happens if (when) the judge agrees with Smith? Is this then appealable to the Circuit and then the Supremes? Or is it an issue that can only be used after a trial as part of a post-conviction appeal? Thank you!

Reviewing Judge Chutkan’s “in-appropriate remarks” about Mr. Trump multiple times in charging multiple defendants, it is apparent that she has not only shown partisanship, but actually judged him as guilty several times in her courtroom, mixing the President’s guilty verdict with the defendant’s, so it is not exactly clear who the guilty party is (leaving the door for appeal open for the sentenced defendant.) Yet Smith opines her remarks were below the bar for recusal! If pronouncing guilt on the wrong defendant is not enough, what is?

Chutkan needs to recuse herself, yet likely won’t. Is there a higher authority in the court to recuse her? Perhaps in the Appellate Court?
