A federal judge has put a halt--for now--to the production of 17 million records related to holders of commercial driver’s licenses. Trump’s Department of Transportation is fighting it.
So the safety of our highways is not important? Illegals driving 80,000 lb. Trucks are not a threat to innocent American lives? Homeland Security should hire as many as it takes to stop every truck and inspect their logs, company and most important their license!! If found to be illegal in any way lock them up and deport every one of them! This is a senseless ruling.
Why is the federal government permitting a private entity to maintain the records of all CDL licensees? If the federal government is entitled to access these records, they should be maintained solely by the federal government, or one of its entities that it has direct oversight upon. There should not be an entity that can refuse this type of request just because it exists as a go-between entity.
Additionally, there needs to be a system whereby these judges that act above and beyond the scope of their duties should have strict liability applied to their acts. When they violate laws beyond their scope, there should be a provision that requires they abdicate their position as a judge, and step into permanent retirement without benefits. That Anthony Tremga appears to qualify for the boot up his rear.
DoT needs to stop "threatening" to withhold funds and actually withhold funds. Only Uncle Stupid continues to pay entities that violate their contracts. If Julie Kelly stopped delivering worthwhile content (not that that would ever happen) I simply cancel the subscription. Not Uncle Stupid. He just sends a letter and keeps right on paying.
The “goose and gander” question turns on whether the earlier disclosures under the Biden Administration and today’s demand are legally comparable. Julie Kelly contrasts reported sharing of motor vehicle data with nonprofits against resistance to DOT’s demand for commercial driver records. Judge Trenga’s order addresses the latter: bulk transfer, statutory authority, confidentiality, and threatened funding consequences. It also states that individualized federal queries remain available, whatever that means. Justice must satisfy the appearance of justice, Potomac convolutions aside.
Thanks for this piece, Julie. After reading it I have only one comment to make pertaining to this ridiculous interference coming from so-called "sanctuary states." And this really has nothing to do with the attempts by Secretary Duffy and his cohort, Secretary Mullin, to go after fraudulent commercial driver schools. Why hasn't President Trump's Department of Justice gone after these sanctuary states? Because, when you give serious thought to the issue, any sentient person would realize that there isn't a dimes bit of difference between them and Georgia and Alabama circa 1856. Both the modern equivalent, say Illinois, and one of the Confederate states, say Mississippi, share one primary thing in common and that is to claim that federal laws have no jurisdiction inside their borders. Don't you think it's time that the feds do something about this situation?
I know personally of accidents locally resulting in deaths and physical damage caused by these very illegals with CDLs. It is past time to stop this. Also allowing this large trucks from other countries into the US should be stopped unless the drivers can qualify in English proficiency
